Mediation & Collaborative Lawyers & Law Firms

Although not supervised by the courts, collaborative law is when both parties agree from the outset to resolve disputes without going to court. Each party is represented by an mediation & collaborative law lawyer, and negotiations are held in a series of four way meetings to work out whatever issues are involved. If the collaborative process fails because one party decides to seek litigation, both parties must find new mediation & collaborative law lawyers, as collaborative law lawyers are not permitted to handle litigation. Mediation is a conflict resolution process in which one or more impartial persons intervene in a conflict with the disputants' consent and help them negotiate a mutually acceptable agreement. The mediator does not take sides or decide how the dispute should be resolved. Not all lawyers practice collaborative law, and both parties must hire their own lawyer trained in collaborative law for the process to happen.
